Vietnam visa and foreign work permit procedures

Vietnam visa and work permit procedures are a complicated procedure to get started in Vietnam for the first time. This time, I will explain the procedure for a long-term stay in Vietnam and the points that foreigners should be aware of.

The number of skilled foreign workers coming to Vietnam is steadily increasing, exceeding 80,000 at the end of 2018. The reason foreigners come to Vietnam is, in the case of foreign contractor employees, to set up a project for direct investment in Vietnam (FDI). So far, we have welcomed foreigners from more than 100 countries.

Permission to hire foreigners

Vietnam-based companies are allowed to hire foreign human resources as managers, directors and specialists if local human resources are not sufficient for manufacturing and operating businesses. Unlike other Asian countries, Vietnam representative offices can also hire staff directly.

When hiring a foreign employee, the company must publicly announce the job offer to Vietnamese job seekers in Vietnamese newspapers and online portals 30 days before hiring.

This is a proof that foreign talent is needed, so we will open the job to Vietnamese. After that, it is necessary to fill in the application form for the work permit of the foreign employee.

Vietnam visa type

To enter Vietnam, foreigners need a visa issued by the Vietnamese embassy or consulate. Citizens of ASEAN countries receive a visa valid for 15 to 30 days. We also accept online visas valid for 30 days in 80 countries (e-visa policy).

For long-term stays in Vietnam, foreigners must apply for a 3-month visa and a multi-visa that allows multiple entry.

Work permit procedures and requirements

A work permit is required to work in Vietnam for more than 3 months. The employer must apply to the Ministry of Occupational Safety and Health (MoLISA) before foreign workers can start hiring. It can take up to 10 business days to create.

If a work permit is not required, you must notify the Ministry of Occupational Safety and Health at least 7 days before working in Vietnam. Currently, foreign work permits are valid for up to 3 years and cannot be renewed. If the company wants to continue hiring foreign workers, it will need to create a new application.

Foreign Work Permit | Application Requirements

  • 18 years old and over
  • Sufficient health to meet job requirements
  • Managers, executive directors and professionals with the technical skills and knowledge required for the job
  • Not subject to criminal prosecution or criminal judgment in Vietnam or abroad, no criminal record

Foreigner work permit | Permit expired

  • Expired work permit
  • Termination of labor contract
  • The contents of the labor contract do not match the contents of the work permit
  • Dismissal
  • Withdrawal of work permit by Vietnamese government authorities
  • Termination of business of companies, organizations and partners in Vietnam
  • If criminal punishment or missing

Foreigner's work permit | Not required

  • Work within 3 months
  • Owner or member of a limited liability company
  • Member of the board of directors of a limited partnership
  • Visit Vietnam for the purpose of selling products and services

As a trend in recent years, Vietnamese authorities have tightened work permits. If you work in Vietnam without a work permit, you may be punished or repatriated within 15 days. In addition, employers may be subject to penalties of up to US $ 3,300 and may be ordered to suspend operations for three months.

Temporary Residence Card (Temporary Residence Permit)

A Temporary Stay Card (TRC) can be granted to foreigners and senior managers who hold a work permit valid for one year or more.

The TRC is issued by the Immigration Bureau and is valid for 1 to 5 years depending on the type of visa.

People who have been granted a TRC can enter and leave Vietnam without a visa within the validity period of the TRC. It usually takes 5 business days from application to issuance, but fees vary from $ 60 to $ 100, depending on the duration of the card.

Permanent Resident Card (PRC)

In Vietnam, foreigners with legal residence can also apply for a Permanent Resident Card (PRC). The application conditions are as follows.

  • Engaged for Vietnam and given the title by the Vietnamese government
  • Foreign residents have temporarily stayed in Vietnam for more than 3 years in a row and are sponsored by parents, spouses or children who are Vietnamese and have permanent residency in Vietnam.
  • Government-recommended scientist or expert

It usually takes 5 business days from application to issuance and the fee is $ 100.
